Welcome to Ultimat (“we,” “our,” “us”). By accessing or using goultimat.com (the “Website”), booking services, or paying a deposit, you agree to these Terms of Use. If you do not agree, please do not use the Website.
1. Services Provided
Ultimat provides premium EVA decking services, including:
3D laser measurement
Custom design and layout approval
Installation
Deck removal (if requested)
Customer support and warranty services
All services are delivered through scheduled appointments.
2. Booking & Deposits
2.1 Measurement Deposit
To secure a measurement appointment, a $400 deposit is required.
This deposit is fully refundable if canceled at least 5 days before the scheduled appointment.
If canceled less than 5 days prior, the deposit is forfeited.
2.2 Installation Deposit
After measurement and design approval, a $5,600 installation deposit is required to reserve an installation date.
This amount is non-refundable, as materials are cut and prepared immediately after approval.
If you choose not to proceed after measurement, a $600 measurement and design fee will be charged, and you will receive your measurement files.
2.3 Final Payment
On installation day, you will pay the remaining balance based on:
Actual material usage
Approved add-ons
Any agreed modifications
Payment is processed through Stripe.
3. Service Process
A typical service includes:
Scheduling and deposit payment
On-site 3D laser measurement
Review of colors, patterns, options, and add-ons
Layout generation and approval
Installation deposit payment
Scheduling installation date
Final on-site confirmation
Installation
Warranty activation
4. Customer Responsibilities
By booking services, you agree to:
Provide accurate information during booking
Ensure safe and reasonable access for measurement and installation
Review all layouts and proposals carefully before approving
Pay required deposits and final balances on time
5. Intellectual Property & Content
Customers may share images, videos, or feedback voluntarily. By doing so, you authorize Ultimat to publish such content on our website, social platforms, and marketing materials unless otherwise requested in writing.
Ultimat retains full rights to:
Designs
Measurements
Templates
Visual layouts
Website content
Marketing materials
Unauthorized reuse or replication is prohibited.
6. Warranty
Ultimat provides a lifetime warranty on:
Material (EVA decking)
Workmanship
Warranty covers:
Defects in materials
Manufacturing issues
Installation faults
Warranty does NOT cover:
Damage caused by misuse, negligence, or improper cleaning
Impact damage, chemical exposure, sharp-object abuse
Modifications done by third parties
Normal wear and tear
If material failure is suspected, samples may be submitted to a certified lab for analysis:
If failure is due to material defect, Ultimat covers all repair/replacement costs.
If failure is due to abuse or improper use, the customer will cover all costs, including inspection, replacement, and labor.
7. Limitation of Liability
To the maximum extent permitted by law:
Ultimat is not liable for indirect, incidental, or consequential damages.
Liability for any claim is limited to the total amount paid for the service.
8. Dispute Resolution
Any disputes shall be resolved through binding arbitration in the State of Florida.
By using the service, you waive the right to participate in class-action lawsuits.
9. Modifications
Ultimat may update these Terms at any time. Continued use of the Website after updates constitutes acceptance.
